Tempo Boxing Terms & Conditions

Tempo Boxing will send an email to the customer no later than one day after receipt, confirming the order of the goods or services. If the services or goods are not immediately available, the customer will be immediately informed of the delivery times.

Personal Training Lesson Terms & Conditions

  • Cancellations must be made 12-hours before your scheduled appointment. If you cancel your lesson after the 12-hour cancellation limit you will be charged for the lesson.
  • On the occasion that your preferred coach cannot train you on the day of your scheduled lesson a substitute coach will be provided. Tempo Boxing reserves the right to choose your substitute coach.
  • If, for any reason, your Tempo Boxing coach cancels your lesson under the 12-hour cancellation limit, and we cannot find you a substitute coach, your next lesson will be free.
  • All free lessons must be completed within 2 weeks of the missed lesson and will require that you make space in your schedule to fit in the free extra lesson along with your regularly scheduled lesson. If your fitness and health mean as much to you as it should then fitting in an extra free lesson will be seen as a plus not a minus. If you don’t book your free lesson within 2 weeks you will lose the free lesson.
  • Once you agree to a program, you must adhere to the number of lesson(s) per week and per month. No exceptions.
  • Any lessons canceled before the 12-hour limit must be re-scheduled and completed within 2 weeks of the cancellation or they will be lost.
  • Missed lessons due to the student’s negligence cannot be made up, and you will be charged.
  • Tempo Boxing coaches will do their very best to be flexible and work with your schedule but excessive shifting of training times and days will not be acceptable and will eventually lead to you being declined as a student. Find days in the week that work best for you and stick to them. Consistence is key to achieving results.
  • Lessons cannot be placed on hold. It is the student’s responsibility to choose a program that fits their schedule and complete the lessons prescribed for that program.
  • It is the student’s responsibility to book their personal training lessons. Tempo Boxing coaches will only advise you on times that may work best. Any missed lessons due to the student’s failure to book the lesson can and will be lost at the close of the month in question.
  • If you plan on discontinuing your lessons for any reason, you must give no less than one month notice in writing by email. Send email to This e-mail address is being protected from spambots. You need JavaScript enabled to view it .
  • If a medical condition prevents you from continuing training for a certain period, you must present a doctors note within 10 days of your diagnosis. If you are not well enough to travel you can scan the note and send it to Tempo Boxing by email. Tempo Boxing reserves the right to treat each medical condition and the status of your membership, lesson payment, and training program, in the way that we think is acceptable. We will, however, treat each medical condition fairly and objectively.
  • There are no refunds for personal training or group lessons. All sales are final.
  • Tempo Boxing will respond within 48 hours to customer queries via email or telephone.

Facility Membership Terms & Conditions

Dues:

Member agrees to promptly pay all the monthly charges and dues after being accepted for membership. The first month’s dues or pro-ration thereof will be due upon signing the contract. Dues will be billed on the first of the month and are due and payable with or without a statement. If delinquent more than 30 days, The Facility may cancel Member’s membership and begin collection proceedings to satisfy Member’s total membership obligations under this Agreement. A 30-day notice will be given whenever there will be an increase in dues to maintain the quality of The Facility. If so desired, Member may terminate his or her membership during such 30-day period.

Cancellations/Assignment:

Member may cancel this Agreement with a penalty payment of ¥10,000 or two months’ dues, whichever is greater. Member’s membership can be canceled without penalty if Member moves more than 50 miles out of the area. Failure to use the membership does not relieve Member of liability for payment. Member’s membership is non-transferable and non- refundable, and may not be assigned or canceled by Member, except as provided in this Agreement. The Facility may transfer or assign this Agreement without Member’s consent.

Term:

After a Member has completed the term of his or her membership (as set forth on the application page), Member’s membership will automatically renew for another period of equal length unless Member provides The Facility written notice of cancellation at least 30 days prior to the renewal date. Membership cannot be frozen.

Additional Fees:

Member will be subject to the following additional fees:

  • A 1.5% monthly finance charge (18% annually) is added to past due accounts.
    Minimum finance charge is ¥500.
  • There will be a ¥2,000 late fee if dues are paid after the 15th of the month or if the EFT is declined.
  • Checks are NOT accepted.

Rules and Regulations:

Member agrees to abide by the rules and regulations that may be promulgated from time to time by The Facility. Member agrees that violation of such rules and regulations may cause Member’s membership to be immediately terminated in the sole discretion of The Facility.

No Waiver:

The Facility does not waive its right to have future payments made when due if The Facility accepts a late or partial payment or delays in the enforcement of its rights on any occasion.

Default:

If Member in any way defaults in the performance of his or her obligations under this Agreement, then The Facility may immediately demand and be entitled to payment of all unpaid installments. If Member’s failure to pay any one or more of the payments due under this Agreement results in The Facility retaining an attorney for collection of the payments due hereunder, Member will be responsible for the payment of court costs and reasonable attorney fees.

Liability Waiver:

It is agreed that all use of The Facility will be undertaken by Member at his or her own risk. The Facility expressly disclaims all warranties, express or implied. It is further agreed that The Facility, its owners, members, managers, employees, representatives, and agents will not be liable for any damages - direct, consequential, exemplary, special, punitive, or otherwise -arising from personal injuries sustained by Member on or about The Facility’s premises or as a result of Member’s use of the equipment therein. Member’s sole and exclusive remedy for breach by The Facility will be the return of any pre-paid membership dues. Member accepts full responsibility of any injuries or damages that may occur to the Member on or about The Facility’s premises and further agrees that The Facility will not be liable for any damage, loss or theft of Member’s personal property. Member does hereby fully and forever release and discharge The Facility, its owners, members, managers, employees, representatives, and agents from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether they be known or unknown, anticipated, or unanticipated, resulting from or arising out of Member’s use or intended use of The Facility and equipment therein.

Member’s Physical condition:

Member represents and warrants that Member is in good physical condition and that he or she has no disability, impairment or ailment preventing him or her from engaging in active or passive exercise or that may be detrimental or inimical to his or her health, safety, comfort, or physical condition if he or she does so engage or participate.

Unavailability of Facility:

The Facility reserves the right, and without prior notice to Member, to temporarily close The Facility or a portion thereof, for remodeling, improvements or repairs. The Facility reserves the right to permanently close The Facility, and in such event, the Member’s membership will be terminated.

Use of Facility:

Member agrees to be subject to the control and guidance of all The Facility staff while on The Facility’s premises and will follow the instructions of the staff. Member agrees to conduct himself or herself in a quiet, well-mannered fashion while on The Facility’s premises. In the event of an accident, Member agrees to be examined at Member’s sole expense by a licensed physician and Member agrees to complete and return The Facility’s accident and injury report form to The Facility.

Indemnification:

Member agrees to indemnify and hold The Facility harmless for any and all liability, loss, claims, expenses (including attorneys fees), and other damages (collectively, "Damages") resulting from a breach of this Agreement or caused by member in connection with his or her use of The Facility or the equipment therein, including property damage and personal injury or death.

Guests:

Membership does not include the right to extend the use of The Facility to guests. Notwithstanding the previous sentence: (i) any act or omission of a Member’s guest will be deemed to be an act or omission of the Member for the purposes of this Agreement; and (ii) if Member’s guest makes a claim against The Facility for personal injury or otherwise, then Member will indemnify and hold The Facility harmless from any and all Damages arising from such claim(s).

General:

The provisions of this Agreement are severable. If any provision of this Agreement is declared to be void, not valid or unenforceable, it is the intention of the parties to this Agreement that the remainder of this Agreement remain valid and enforceable. This Agreement and the rules and regulations referenced herein represent the entire agreement between The Facility and Member. The Facility will have all rights and remedies provided by law and the remedies provided in this Agreement are cumulative. The laws of Tokyo Japan govern this Agreement. Member must be 18 years old or older. A photocopy of Member's driver's license (driver license is acceptable only if they are a citizen of the country) Foreign Registration Card, or Passport is required to complete this Application/Agreement.
